On 5 February 2025, the Information Commissioner's Office published Guidance: Keeping employment records. This final guidance replaces the draft version (see FC Feature 13 December 2023).
The guidance aims to help employers understand their obligations under the UK GDPR and Data Protection Act 2018. The guidance sets out how employers can lawfully process workers' personal information, workers' rights to access their employment records and responsibility for data protection and record keeping in an organisation.
The ICO recommends that the guidance be read alongside other ICO guidance on data protection and employment, in particular Guidance: Information about workers' health (see FC Feature 1 September 2023).
